TAXES
All prices are taxes extra.
PAYMENT TERMS
1% 10, net 30. Invoices are subject to a 1% discount when paid in full within 10 days of the invoice date. If early payment is not possible invoices are to be paid in full within 30 Days of the invoice date.
Orders may be held up if any unpaid invoice is over 30 days. We reserve the right to take out of the shipping and production schedules, orders from accounts with unpaid invoices of 60 days or older.
SHIPPING POLICY
[Prepaid Freight]: All orders of $1,200+ net will be prepaid to one destination. All back orders from a prepaid order will also be prepaid. Prepaid shipments will be made from the closest Canadian Dixon Warehouse.
[Collect Freight]: All orders of less than $1,200 Net, will be shipped collect (F.O.B. Dixon warehouse), as will any back orders on these orders. If a mode of transportation is requested where the freight must be prepaid, it will be charged back on the invoice.
[Direct Shipments from the USA]: All shipments under $300 net are subject to a $20 Customs handling fee.
CLAIMS
No claims allowed unless made within 5 days from receipt of goods.
PRODUCT RETURNS
- All returned parts require a "Return Materials Authorization" (RMA) number. This will enable Dixon to credit your account promptly and correctly when parts are returned.
- The reason for the return request along with the Dixon packing slip or invoice number must be given to Dixon at the time that the "Return Materials Authorization" (RMA) is requested. The RMA number is to be clearly marked on the return.
- All customer error returns and excess stock returns must be returned freight prepaid and are subject to a minimum 15% restocking fee.
All returns of either defective items or products shipped by Dixon in error are to be returned via the carrier specified by Dixon, at Dixon's expense. All returns must be shipped to the Dixon location designated on the RMA. Any unauthorized returns will be refused or shipped back to the customer freight collect.
- Returns of only complete devices in original packages will be considered. "Soft" goods (seals, gaskets, lubricants, plastic tubing etc.) will only be accepted if in new, unused condition, and can only be returned within 6 months from date of purchase. Items sold per box quantity can only be returned in box quantity, i.e. worm gear clamps, band clamps, tuff-lite, brass ferrules, etc. Acceptance of specials and slow moving items will be treated on a case by case basis.
- When packing parts please put heavy parts on bottom and lighter ones on top to avoid damage in transit. Please separate and identify all items.
- Dixon recognizes the need for a distributor to adjust inventory to remove slow-moving items and establish an active inventory which provides for the best service to our customers. It is our goal to work with our Distributors to accommodate this need. We reserve the right to not accept return goods when market conditions or other circumstances make the acceptance of these returns overly burdensome.
The amount allowable for return will be determined by the previous year's net purchases. The value of returned stock shall be the list price, less discount, in effect at the time of original shipment. (A restocking charge of a minimum fifteen percent (15%) of the net value of the merchandise returned will be assessed on all excess inventory returns) The returned stock must be items for which there is sufficient current sales activity to enable Dixon to resell it within one year.
- Any unauthorized returned stock will be scrapped or shipped back to the customer freight collect per the customer's choice. The customer has ten (10) days to advise Dixon as to the disposition of any product returned for credit but disallowed by Dixon.
LIMITED WARRANTY
Dixon Group Canada Limited, (herein called "Dixon") warrants the products described herein, and manufactured by Dixon to be free from defects in material and workmanship for a period of one (1) year [Three (3) years for "Flotech" overfill detection products] from date of shipment by Dixon under normal use and service. Its sole obligation under this warranty being limited to repairing or replacing, as hereinafter provided, at its option any product found to Dixon's satisfaction to be defective upon examination by it, provided that such product shall be returned for inspection to Dixon's factory within three (3) months after discovery of the defect. The repair or replacement of defective products will be made without charge for parts or labor. This warranty shall not apply to: (a) parts or products not manufactured by Dixon, the warranty of such items being limited to the actual warranty extended to Dixon by its supplier; (b) any product that has been subject to abuse, negligence, accident, or misapplication; (c) any product altered or repaired by others than Dixon; and (d) to normal maintenance services and the replacement of service items (such as washers, gaskets and lubricants) made in connection with such services. To the extent permitted by law, this limited warranty shall extend only to the buyer and any other person reasonably expected to use or consume the goods who is injured in person by any breach of the warranty. No action may be brought against Dixon for an alleged breach of warranty unless such action is instituted within one (1) year from the date the cause of action accrues. This limited warranty shall be construed and enforced to the fullest extent allowable by applicable law.
OTHER THAN THE OBLIGATION OF DIXON SET FORTH HEREIN, DIXON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY OTHER OBLIGATION OR LIABILITY. THE FOREGOING CONSTITUTES DIXON'S SOLE OBLIGATION WITH RESPECT TO DAMAGES, WHETHER DIRECT, INCIDENTAL OR CONSEQUENTIAL, RESULTING FROM THE USE OR PERFORMANCE OF THE PRODUCT. |
